My opposite party won the 2 lower courts , now the case in high court can we get stay?,can we get immediate stay? Because my opposite party in cultivating the land which is under our position by conflicting on us by saying he won last 2 courts. Please suggest us what can we do for stop this.

Hi Shroff Sir,
My Lawyer here is telling , our opposite party is won 2 courts continuesly , before giving stay court will ask him for any objection. i got now through some people saying if you apply Stay or tempory injection we will get by evening. so Please guide us sir.

It is usual practice to either comply with sec 39(3) if ex parte ad interim STAY is passed , and you get stay order by evening, and opp party will object.
u have to check any caveate is already filled? if yes, their objection will be asked.
