- A complainant had purchased a flight ticket in Jammu for a journey which was to start from Delhi to another city. The complainant filed a consumer complaint for deficiency of service against the Airline with the consumer forum at Jammu. The airline argued that the district forum at Jammu had no jurisdiction over this matter as no “cause of action” arose in Jammu because the journey for which the ticket was booked commenced from Delhi not Jammu. However, it was decided that that since the ticket was purchased in Jammu, the cause of action would arise in Jammu even though the journey was to commence from Delhi.
- A complainant filed a complaint against a university before the Shimla District Forum. Though the university was located within the jurisdiction of another forum, the jurisdiction of the Shimla Forum was validated as part of the cause of action was considered to have arisen in Shimla because the money for enrollment was sent to the university from Shimla and the result was sent to the complainant by the appellant at his residence in Shimla.
