Neither flat, nor booking amount is gven

Hello, I booked a flat in 2013, the project did not complete. The builder left the project. N till date he has not refunded the booking amount neither there is any progression in construction. they left that site. What should I do now pls guide.

File refund of money qua consumer court and file a criminal complaint for cheating against the builder.
