Dear sir/ madam, I would like to enquire about A) if someone has a property on main mathura road , within 30 Mt restricted belt along Delhi - Mathura Road (NH-2) schedule road (appearing at schedule road number 3, which has been regularised. A)Can The owner , repair ( renovation) the regularised building permitted, due to damages caused by metro rail construction work ? What is the procedure to take permission for renovation of the building B) Are addition of new floors allowed , if yes , then what is the procedure for applying to do so so , how many floors are permissible? C) What are the Rules and laws under which the property is covered ( laws for renovation) D) what is the setback decided by NHAI in the private property land along NH 2 ( CURRENTLY NH19)? Nhai has not replied to my answer yet

The land acquisition process in NHAI is governed by The National Highways Act,1956.

The Department of Land Resources (DoLR) is administering the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act). This Act came into force on 01.01.2014 by repealing the Land Acquisition Act, 1894.

The Amendment Bill passed by the Lok Sabha in March 2015 extended the compensation in accordance with the RFCTLARR Act to the thirteen Acts (The National Highways Act,1956 being one of them) mentioned in the Fourth Schedule of the RFCTLARR Act, 2013.

Thus, NHAI follows the RFCTLARR Act, 2013 (Section 26 to 30) for determining compensation rules for land acquisition.
