No agreement between shop owner and tenant

Respected Sir,i belong to jalandhar city (punjab ). sir my question is this we have one shop which my grand father rented to someone 10 years earlier without any agreement . my grandfather has passedaway and legal owner of that shop is my father now,,,,,now we want to vacant our shop because i want to start my business in that shop but our tenant refused to vacant it . bills had been paying by tenant. but we want our shop back. my father is retired person. sir please guide me positively in this matter .regardsrajnoted -- there is no legal agreement between landlord and tenant...

A. Issue legal notice to tenant for vacating the premises.

B.Later, you can approach the Court to suit for eviction against him.

C. Recently,Supreme Court ruled that if a landlord is doing a business and he wants to extend it and needs additional space, the tenant cannot question him. The judgment is Anil Bajaj v Ahuja dated 8th May 14

Ravi ji...for your specific and valuable advice.....Ravi ji at present we are not doing any business but I want to start my business now so I left the job of marketing so that I can start my business ....so plz guide me on some points..... m1) my father can file petition on the basis that he (father) wants to settle me in business. 2)he is retired army person.
