Non-encumbrance certificate

I have  booked a flat with a builder under construction plan . Builder has given me an allotment letter. He has also made an agreement with me. Both in the allotment letter and agreement, builder in the name of property details, has mentioned the  unit no. and sector no. of his approved layout plan.(Approved by (Govt. Development authority) . These details may be different from the details recorded in books of Sub-Registrar of that area/District. Then how can I get non encumbrance certificate? What I have to do? Is builder legally bound to provide this certificate to the purchaser has to obtain it at his own.

You must have demanded latest EC before entering. However, you can obtain one even now from the sub registrar's office. No, the builder is not legally bound to provide you with EC.
