Not giving position from past 1 Year

Sir,

I have purchased a plot with dimensions 40*40 feet in Bangalore ( B Katha)...

He is asking now to take possession as 41.5*38.5 instead of what I purchased....

Owner behaviour is also very bad...

Can we file a case on him to return my amount (Including registration charges, Tax paid others) and also file compansation for wasting my 1 year with out giving position...

People who purchased plot in that layout complains that he will force to purchase each and every construction materials from his reference(Commission) or Give contract for him of House construction...

For simple practical problems, always consult local advocate and request him to guide.  He may issue a Registered Legal notice to seller demanding for the exact Plot mentioned in agreement or return the advance amoun with interest and compensation.  If the seller fails to respond, file simple complaint in District Consumer Forum as a party in person and the total costs may not be more than rs.500/- and process is simple;  There is deficiency of service as the plot mentioned in agreement was not delivered after collecting advance and purchaser was subjected to harassment.  Every Plot has it's own advantages and disasdvantages like Vastu and religious beliefs, seller can not compel purchaser alternate plot and it all depends on purchaser to accept or reject it.  This is not any consumable article that can be replaced, but involves sentiments etc.
