Notarised sale agreement

I have purchased a 3BHK flat on ownership basis in Kolkata in August'2014 in the name of my mother and myself. I am married having a daughter, too. I have another flat in the same city but on rent under "salaami system", which means I can sell off that flat to a third party and certain percentage of the selling price will be transferred to the present landlord for name change in the rent bill.


My question now arises here. I have not done registration of the newly purchased flat till now as I came to know that until I sell off the first flat if I go ahead with registration then the landlord might file a case in my name as I own a flat on ownership basis. In such a case I might lose out on that flat completely without a single penny coming in hand. A few of my neighbors have suggested to get the sale agreement notarised till such time that I get registration done. Please suggest.

An agreement to sell does not result in alienation. Attestation by notary does not add any value. Your rights will be limited to demanding specific performance tomorrow in the event of any issue with the vendor. You may consider getting the new property registered in favour of any other family member, to avoid this issue.
