Notice 4 Property Tax - No services by municipal corporation

Dear sir,

This site is best initiative to simplify INDIAN LAW and make it accessible to the common man.

I need your expert advice on the following matter.

Vadodara Municipal Corporation ( Gujarat ) , has been adding the peripheral areas in their jurisdiction and just not providing any basic services to that areas ( water supply, street lights, roads or solid waste collection and even drainage)

But, VMC shamelessly keep on asking for property tax from the households, they also issue notice that, by so and so date if you don’t pay tax VMC shall disconnect your water supply. ( LOL )

Is their any judgment for giving discount on regular property tax, if municipal corporations can not provide the basic services ?

Property tax is not the fee. Levy of tax not dependent on the service being rendered by the authority levying such tax. There is no co-relation between the tax collected and the service intended to be rendered

I agree with Mr Sanjeev ! Tax is the liability on the proerty ! Service is connected with  Fee !

Tax  collection is the Genral Income of the Corporation and it has to render services !             Payment of Tax can not be denied on the ground that facilites are  not provided ! Facilities / Service is the demnd  of the public to be attended by the corporation not connected with proerty Tax -

However the Corporation collects the Tax  as its incomce and services are to be rendred as  Corproationa  Unit - Tax can not be connected with services,  as in the case of Fee paid  for services !
