Notice period

Hi

I am presently working in a MNC in Hyderabad.I have resigned and my notice period is of 60days.However,my manager asked me to continue 10 more days aftr completion of notice period to complete some formalities verbally and not in written.So,if I continue to come to office after 60 days,does it imply that I have withdrwan my resignation and they can cancel it on the 61st day??

No. Not at all. Even after notice period, you have to wait and complete your work whatever assigned by the management to you. And do not forget to get relieving order along with full & final settlement from the organisation. So it is useful for next organisation's management good impression.

Dear Samhita,

I think, you complete your pending task within 60 days, if the task were not completed that is your fault. As per Mr. Rama about good impression for next co., that company may also take negative view as you take first step to resign than you continue for next ten day.  Mean you did not able to complete your task within 60 days.  What will happen in his company.

Such matters are best resolved by applying rapport goodwill, exceptional levels of persuasion, persistence, negotiation, reasoning skills.

Let us look at the matter from other perfective.

If you feel that you can extend you may persuade the manager for a written communication to this effect.

If you can not you must convince that you have complied with the notice period and you have your future ventures to take care of.

Your contentions are right. Employee should not leave things to chances and should transact in writing under acknowledgment.

What formalities?

Has he explained these so called formalities??

Have you completed all tasks on hand? If yes nothing is due to be done by you.

(You must keep copies of all record to prove that nothing was pending at your end.)

If he needs you then he should not shy from requesting in writing to stay for another 10 days, and obtain clearance and concurrence from HO of the company………..

 

Let us assume that some tasks are pending, and then if company has designated your replacement, this replacement should have been assigned to you for training on job and handover. If there is no internal/external replacement HOD/Manager should step forward to fill for the outgoing employee.

The arm chairs managers throw tantrums, the doers do not.

The other option is company should ask you to extend the notice period by …………days citing reasons for it e.g. unfinished tasks and comment it shall be paying wages……………or not.

The practices of the companies should be fair and upfront.

The effective CEO’s will always be ready and will succession plan in place.

You have tendered 60 days (SIXTY DAYS/TWO MONTHS) long notice period which should be more than sufficient for employer to put his house in order. Company should have communicated sufficiently in advance for exit formalities if any it desires and should have ensured that exit formalities are completed by company.

This manager ( if he is competent, or the competent employee e.g. appointing authority)  should request fro extension in writing and on record and affirm that wages for the extended period as being requested by the company shall be paid @ as being regularly paid, and period of extension shall be counted in period of service and on dated……………(last day in office) acceptance of resignation, service certificate, correct FNF statement, Payment of FNF dues, Form 16, attested copies of PF withdrawal/transfer forms ( you should submit the forms), NOC/NDC etc shall be handed over.

It does. Companies are known to make a pass on employee and make interpretations as suitable to them.

By serving the notice period as stated in appointment letter you have fulfilled your contractual obligations.

It is up to you now to accede to the request of the company or not!!!

If you have time and can co operate you may gently request this manager to arrange to issue a written communication to this effect, by competent personnel of the company.

If you can not extend, you may ask in writing to whom you should handover the charge and company property and company should designate sufficiently in advance, the employee for this purpose with a copy to you in writing and the designated employee should handover the proper acknowledgment to you on the spot, within and up to your last day in office. You may not forget to add that all tasks have been completed by you and nothing is pending at your end.

 

Let us assume that if this employer wants to terminate your employment then it will tender 60 days notice for you to look for another employment, or more?????

Would it agree to extend the notice period if you do not get another job????

On the other hand if this employer is able to install replacement it shall give notice pay and ask to leave at once. Isn’t it?

No. to your query, further......, Yes, u hav to complete the work alloted to you. but its a responsilibity of your heads that they do not involve you in such work in end period of your notice. which will take long time to complete. Any assignment given to you, which you think will take more time than your notice end date, kindly inform to your superiors to involve some other employee with you so that he/she can carry work ahead after your end date. mail this with soft language mentioning that you do not want the work to be suffered. Do not forget to mark a CC / BCC of said mail to your personal email id for your records purpose. Any resignation ltr should contain words......"after that i will be released from all my liability & responsibility as an employee of organisation"
