Notice period buyout

Hi


I work for a IT MNC. My offer letter states that I have to serve a notice period of 90 days if I intend to resign and there is a buyout clause of Rs 100000. However the offer letter says that it is comapny's discretion whether to accept the buyout or not. I find this clause very unfair in the sense that company is harassing me to serve the notice period even though I am ready to pay the money.


Is the company allowed to have such a clause which they have complete control and employee has no control whatsoever even though there is a buyout clause. And what use is a buyout clause if the company is allowed to accept or reject it.

Dear Nikhil.

Its is unethical practice , as that clause , is violative of prinicipales of natural justice.

Firstly , shoot  them an email, giving them a notice saying that you are prepared to give that byout amount , as per the offer letter for quiting the company and also send the same through reigistered notice acknowledge due.

Thereafter , send the dd to thae company along with resignation letter.This is legal one and they have to accept your letter and relinquish you from the duties.

IT companies in Karnataka now do not enjoy blanket exemption from standing orders. Company should have framed its standing orders within 6 months and till then model standing orders should apply.

It companies are under SE Act of the state.

Model standing orders, IESO Act, SE Act may be available at Dept. of Labor website of your state or you may buy the latest version from market.

Ideally the penalty or notice pay in lieu of notice should be same for employer and employee. What is the notice pay in lieu of notice in case the company issues termination order? Does it specify it shall be the choice of the employee to accept notice pay in lieu of notice period?

What is the logic and ground for determining the amount of penalty for employee as Rs.100000/.

The notice pay ideally is @ Basic + DA, as employer disburses gratuity, paid leave, OT, Bonus….. at this rate.

 

Were you persuing some critical project of the company and have you finished it?

 

 

Model standing orders: 13.    Termination of employment.--(1) For terminating employment of a permanent workmen, notice in writing shall be given either by the employer or the workmen - one month’s notice in the case of monthly-rated workmen and two weeks’ notice in the case of other workmen: one month’s or two week’s pay, as the case may be, may be paid in lieu of notice.

The notice pay in lieu of notice in case the company issues termination order? is 3 months salary. But if I choose to buyout the company reserves the right to reject the buyout and force me to serve the notice period. It does not matter if I am pursuing any critical project they always reject the notice buyout.

What they are doing is illegal, you have to fight for justice and you have got every right
