i) National Building Construction Corporation

                               &

ii) Vijaya Bank

Dear, No need of notice U/s 80 CPC prior to filling a suit against NBCC.

It would be beneficial for the plaintiff (claimant) to issue notice u/s 80 CPC.

When it is just a notice, it is always better to issue the notice and give them enough time as the process of admission, giving number and serving summons take minimum of 90 days, further it can stated in the plaint also the exigency of filing such suit and confirmation that notice was issued.  (it is a different matter that this is just a legal process, and the Govt organisations equipped with sufficient legal experts will not take any such notice seriously)

However, it was originally meant to be much more than a"just a legal process", but our indifferent bureaucracy has degenerated the sanctity of this provision, resulting in the Government is the biggest litigant.

Unfortunate thing, is even after a National Litigation Policy.
