mr.koyel,
just read sec 415 to 420 of ipc. you will get your answer.
if fraud placed before
a matrimonial court - the punishment is nulty of the marriage;
if in criminal court - under sec, 415 to 420 - the punishment is imprisonment
a charge of rape also may be constituted in case physical relationship established.
but fraud and rape both to be proved at court; burdain of proof lying on the complainant.
what type of fraud, whether at all it is a fraud or not, in the eyes of law - it is also to be checked.

Hi,
Within Gujarat, what if it has been identified that girl has somehow registered a marriage without any form of social marriage being performed, in a local Registrar's office, that also in the absence of the NRI boy and his family...Does this constitute fraud and can the certificate be nullified using criminal law in some form?....
Also, since the boy and his family were not present...and signatures on the original memorandum application are not those of the boy's signature and the girls family self witnessed to prove marriage occurred...Does this allow the boy to immediately cancel the certificate and have it removed from record?...alongwith allow the boy's family to apply for financial compensation from the girl's family to repay for deformation of family name?...
