Occupancy certificate in Mumbai

 

Hi,

A property located in Mumbai, constructed in 1980's with a Co operative Society established in 1986, does not have an occupancy certificate.  THE Commencement Certificate is available.

 

Agent provides with photocopy of the blueprint of the building and says the blueprint can be substituted for OC along with CC.

 

Although the Building is 4 floor building Blueprint says layout for ground floor and first second third typical layout. How important is the OC in respect with the Mumbai property law. Does it hinders the value of the flat?

 

I am looking for a bank loan. Would Bank do all the checks in the title verification  and the validity of the flat, before I go for the sale agreement registration.

Occupency Certificate is a legal permission by Govt body to builder allowing him to sale flat after which people can occupy flats for living. On paper, it means that govt. has granted permission to builder after inspecting that building is OK & can be used for public use / staying. OC is granted by govt. when builder fullfills terms & conditions mentioned by Govt. e.g building alignment, safety measures, quality of work / material, quake proof etc The electricity , water connection provided to this kind of building is not legal or in other words is on humanitarian grounds till the builder occupy the OC (Humanitarian grounds attracts more charges compared to normal). In many top rated areas building which does not have OC, rates of the flats will drop compare to beside building who has OC. In Nut shell, OC is not important for you till you are away from any legal battle on land / property. But once paper work comes in picture, you will start facing music.
