P.C.P.N.D.T.ACT , ACQUITAL OF APPELLENT DOCTOR ACCUSED BY SESSIONS COURT,  BY SETING ASIDE JUDGEMENT OF  CONVICTION  BY CHIEF JUDICIAL MAGISTRATE COURT.THANE

1. HONOURABLE SESSIONS COURT , THANE ACQUITED THE APPELLENT DOCTOR ACCUSED BY SETING ASIDE THE JUDGEMENT OF CONVICTION OF CHIEF JUDICIAL MAGISTRATE COURT,THANE UNDER PROVISIONS OF P.C.P.N.D.T.ACT.

2. IT WAS OBSERVED THAT THE COMPLAINANT WAS NOT APPROPRIATE AUTHORITY UNDER THE PCPNDT ACT , AND DELAY IN FILING COMPLAINT, STATEMENT OF ACCUSED IS NOT A CONFESSIONAL STATEMENT AND SOME CRUCIAL SEIZED ARTICLES NOT PRODUCED IN COURT AND CONTRADICTIONS IN STATEMENTS OF WITNESSES AND OTHER LAW POINTS WERE CONSIDERED BY THE HONOURABLE COURT IN SAID JUDGEMENT.

3. HONOURABLE COURT HAD TAKEN INTO CONSIDERATION THE JUDGEMENT OF BOMBAY HIGH COURT , BENCH AT AURANGABAD WHILE DECIDING THE POINT OF APPROPRIATE AUTHORITY.
