Partition

10 sharers to a inherited property.  9 combine together and divide the property themselves apportioning equal or even more shre to the 10th person.  On the strenght of the partition, patta has also been granted by the Tehsildar.  Is the partition valid in law??

Thanks Gentlemen,

A Muslim leaves his property intestate.  Total legal heirs are 10 persons.  They want to partition the property amicably.  All agrees but one.  The agreed nine persons make an deed (unregistered) by which they make a partition.  They allot a larger portion to the 10th person who neither concurs nor accepts the partition.  What is the legal position of the partition made by them??

First of all determine the deceased was a Shia or Sunni or Muslim that followed some other sect/faith amongst muslims.
