The rate of court fee depends upon the cause of action as well the character of suit property. In a partition case, court would be nominal if the property is in joint possession. Actual amount of court fee varies from State to State.

The issue depends on possession and remedy requested.

seems like my question is not understood correctly.
i didnt ask for the amount of court fee instead  i asked
for whether if the court fee is based on market or guidline value.
this is not for a joint possession property.

If the plaintiff is out of the possession (ousted from possession) then court fee has to be paid as per certificate given by the Sub Registrar on market value of the property.

If it is a declaration suit praying for setting aside any sale etc. as the salel deed was executed without authority or fraud, then the value depends on suh sale deed value shown in the document.
