Partition undivided land ownership

Hi Everyone,

We have a undivided property in Tamilnadu valued around Rs.36,00,000/- (approx. 25 cents). The document is in the name of father and he is no more. The property unintentionally by inheritance and his legalhairship are 5 persons (One Wife, Three Sons, and One daughter). At the moment the division will not occur amicably because of one uninterested person who living in that place. In this circumstances the property should be divided by other persons. What is the best way to do this with least stamp duty?

All the members of family / legal heirs shall discuss mutually and enter into a family settlement reduced in writing and register the same. This does not attract stamp duty.

Of course, all the family members are willing for partition it is ok. But in our case, one legal heir members is not willing to divide now. What we can do?
