Passport renewal

A person has been living in canada for 11 years and the passport was expiring in Jun 2007.The same was sent for renewal to the high commission of india, who returned it changing the renewed dates upto 2017(tampered).Since it was received directly from Indian high commission the person thought to be authentic and did suspect any foul play. The  person came to India on 19 dec2011 and the immigration authorities found it was tampered and seized it. FIR under passport act is registered and we are seeking information regarding date of submisson and return of passport and any other details from the indian high commisson to prove the innocence of the person. This person is working at Toronto and may loose the job if he is held up in India. Also he is married to a canadian national 4 months back at Canada

A reputed lawyer is seeking quashing of the FIR on grounds that the person has been staying for 11 years and would have got  canadian citizenship ,but for emotional ties to own country did not apply for the same.Also,having a reputed job in canada and as Indian citizen when it is his right to get renewed , why should he tamper  and obviously someone in high commisson had misused his position to divert the the entittled passport for some unknown reason.

Can anyone advice whether the legal course is correct and also whether he is eligible for reissue of new passport ,once the case is quashed.
