Payment of gratuity

The Management remitted the gratuity amount ordered by the controllin Authority.Thereafter, the Management filed writ petition in the High Court and pending for the last four years.But, the Controllimg Authority refuses to release the gratuity amount pointing out the writ .There is no Stay in the writ petition.What is the remedy?

No remedy. If the aggrieved employee is a senior citizen then you can move an application for early hearing of the writ petition.

wait for court orders.Authority cannot do anything without court order.

Seek urgent hearing. Non-rlease of the gratuity, eventhough the emplyer has remittted the amount, could certainly a grouns for seeking expeditious disposal.
