Pending salary

Dear Sir, I was working in a private company from 2007 september to 2008 August. Then i got a central govt. job and resigned my private job and properly releived from the company and  got releiving order. But i have not received the settlement mainly( last month salary around 30,000/-) i have requested the company through mail and phone call but no response. Now the company has shifter its location from the existing place. what shall i do is is possible to get my salary.

If you have resigned with immediate effect without serving notice period then as per your appointment letter company shall adjust notice pay in FNF settlement, and pay all dues payable to you e.g. salary, paid leave, bonus, incentive etc.

You may demand FNF statement, form16, PF number-accumulation reports-attested copies PF transfer/withdrawal forms, etc.

You may prepare a list of payables by company to you and by you to company and ask the company to verify and supply correct FNF statement to you.

As per SE Act Company should pay the dues on last day in office or within 2 days. SE Act can be accessed Lbor website of your state.

Even if company has changed address you can approach Inspector under SE Act, O/o Labor Commissioner, and Inspector under Payment of Wages Act at your location.

You may take the help of elders in the family, competent and experienced well wishers, or  lawyer to prepare your representation to company and these Labor Authority.

Thanks for you reply sir. I have given the one monthnotice( its as per my appointment order) before my releiving from the company. It is very difficult to contact and get the details of PF and other documents from them. im residing in Tamil Nadu.

You may submit a gentle representation in writing addressed to the good offices of your appointing authority, MD, Chairman, and Company Secretary with a copy to Head-HR, by registered post mentioning detail of each representation made by you so far including by email ( mention your email id date, time, recipient’s email id name , designation, department, address) by phone(mention your phone number date, time, recipient’s phone number, name , designation, department, address) in person etc and request the good offices to provide relief and supply you the payment of dues by Bank DD and documents e.g. acceptance of resignation, FNF statement, form16, PF number-accumulation reports of all previous years-attested copies PF transfer/withdrawal forms ( you may obtain the forms from local PF office and fill them and enclose the forms and mention that form number………duly signed and filled by you except PF number as it is not supplied to you) by redg. post so as to be supplied to you say within next 7 days. You may mention that postage prepaid, self addressed envelope is enclosed herewith for sending all of the above to you by redg. post. You may mention that the acknowledgment issued by PF office ( under seal of PF office with date of receipt) of your PF forms should be supplied to you by redg post only. You may also mention that company has issued relieving letter to you.

Company is duty bound to submit the PF forms to O/o PF commissioner within 5 days.

You may supply soft copy of the representation by email also, and attempt to obtain acknowledgment. You should try and obtain new email id of the company.

Relieving letter is issued after all settlements due at the end of employee are completed by employee; hence nothing is due against you.

If you face any difficulty you may take the help of elders in the family, competent and experienced well wishers, to draft and structure your representation to good offices.

If no relief is granted by good offices, you can lodge a complaint with o/o Labor Commissioner, Inspector under SE Act, Inspector under Payment of Wages Act, at your location. You can also lodge complaint with O/o PF commissioner for not providing PF number, PF accumulation reports and acknowledgment of PF withdrawal or transfer forms.

Or you can a lawyer known to your family at your location and a legal notice by employer mat fetch you relief.
