Pension stopped illegaly

Helo Sir

My 62 year old friend was receiving her postal service retirement pension from 3 years, but in August 2020 the pension department has stopped her pension without any Notice, on her inquiry she was informed that because, she has rent income from her imm.properties, therefore she is not entitled for service pension. Even more department is intended to recover from her last 2 years pension on this account.

2. Sir what remedy can she avail in these circumstances.

First get the exact reasons in writing for stopping pension from authorities by filing RTI Application under the Life or Liberty clause.  The reasons stated by you may not be appropriate. You can get such exact reasons in writing within 48 hours from the dept.,  Then contact local pensioner's associations.   There are many good samaritans to help and make you understand the reasons and for seeking a proper remedy as stopping pension appears illegal, arbitrary and amounts to harassment of a dependent pensioneer.  The reasons you have stated appears most inappropriate.

It is impossible that,  once PPO is authorised and issued, pension could be stopped as posted. It could be that the information you have received is factually incorrect. Please verify.

Service pension and immovable property are two different subjects dealt in different heads of Income Tax Act, 1961, which has no "correlation" and/ or relevancy .

Service pension can not be stopped in such circumstances, as alleged.

Unbelievable and fabricated facts posted by an advocate.
