Perjury in dv interim maintenance 23(2)

Hello Friends,

Wife lied in application of Interim maintenance 23(2) under DV that she is unemployed and not earning. We have her ITR showing some income.

We have to file written response (first)  now. Can we file perjury application along with written reply of DV petition ? Can interim maintenance application denied on this sole ground ?

Please suggest.

In the ITR what has been stated as ragard to income source and by whom it is filed.  It may be that the ITR  filed by someother with wrong information as to get the benefit.

The declaration in the ITR has to be proved. However, at the prima facie an application for wrong declaration u/s 340CrPC R/W 199 IPC may be moved. It is your right to file the written statement.

As regards to interim maintenance application denied on this sole ground, it is upto the court and convience.
