Personal loan summon

Dear Sir,

 
 
This is with reference to my Personal loan account number baring 202675100026646.I have taken this loan on November 2009 and Paid my monthly EMI upto August 2011.In march 2011 i have left my job and went to kolkata for taking care of my mother as she was seriously ill.Since then my situation has turned from bad to worse.During that period a long time medical care was suggested and i have to take care of her due to which i could not take up a full time job.This period we had survived on my father family pension and was unable to pay my EMI. Few months back she was being operated and she is doing well now.We have lost all the savings on medical expenses on my father who had expired few years ago and after that of my mother.I am without any job for last 2 years and was unable to pay my EMI.
 
As now i am in a position to join a full time job,I just require 3 - 4 months time to start paying my EMI. My Pan Card No. AKWPA0282C which is already with you and easily can be checked that i was really without any job during this period.
 
This is a mercy plea from my side to IDBI Bank as i was unable to pay my EMI due to unemployment and medical emergency in the family.But if you provide me the above said time i can attach maximum part of my salary as EMI and Close the loan.
 
Now I have got a job having salary of 10000 and ready to pay 5000 from that every month as emi.Today i have got a summon from Lok Adalat to appear on 23th November 2013 .
 
First question is can court accept my proposal as the bank is not agreeing on that.
 
Secondly can i sent a written reply like this

You can appear before the court and request time for filing your Written Statement.(written reply in your concept) The court will definitely gives a time, for filing your written statement. Or engage an advocate on your behalf. Or ask the Lok Adalat court, to pass a installment decree by paying Rs.5000/- on every month.

If case is filed by the bank against you in the court, you appear in the case .  You will get time to file your written statement, you can file your WS and also you can sought time to pay the loan.  You can also approach the bank for one time settlement.

The Lok Adalat is for mutual and amicable settlement.

 

You can ask for the time as deemed suitable to you.

If you have decided to settle before the date in Lok Adalat visit the Bank at your location and negotiate your terms.

Bank is only interested in getting in its money and may agree to get principle amount and may agree to waive off interest and penalties.

 

However You should  obtain NOC and also an undertaking in writing from Bank that it shall remove the delinquency, red flags and default from CIBIL, Equifax, Experian, bad customers list of the bank etc………….and this settlement shall have no adverse effect in your loan taking ability on routine rates applicable to all good customers, in future.
