Pf amount not clearing by employeer

Hi...

I am facing this situation. I worked with company for 10 Months & company was deducting the PF amount from my salary to PF account(account no was mention on salary slip) but when i left the job and tried to withdraw amount from PF account, i found that there were not a single PAISA in my PF A/C this thing i knew when i personally visit EPFO office & meet to concern person. Than I asked to Company MD but he always told me he will manage in some days.

Now its almost 10 Month Passed but no action till date.

Now please suggest what should i do.

The act of the company is punishable under Law. You have to prefer complaint to the PF Commissioner.

The company should have been featuring in list of defaulters maintained on EPFO website:

 

https://www.epfindia.gov.in/

 

The RPFC should have initiated 7A proceedings/process of recovery.

Submit minutes of discussion with concerned PF official that you have met to RPFC with a copy to Addl. CPFC of the state, CPFC and demand to supply you the name of PF Inspector that has visited the company, certified copies of  his report, action taken by EPFO till date and certificate of recovery if any issued till date............ 

 If required peruse RTI route or file criminal complaint against employer u/s Sec 406,420, and consumer complaint against EPFO in DCDRF..................

 

It shall be appropriate to visit a local labor consultant/service lawyer in person and proceed under expert guidance of your lawyer.
