Dear ABCD,

Do not worry about this 125 CRPC. I have been a victim of this for the last 3 years and the case is still continuing. Life is a vicious circle... What goes out comes back! If your estranged wife has put you into this legal mess, the only gift that you would receive is Waste of time & little bit of mental turmoil. But if you're firm & demonstrate strong will to confront such unscrupulous people, you'll be the winner. The repercussions that she would get afterwards will be much more fun to watch. You'll relish those moments. Just be cool, calm and face with determination. My suggestions:

1. Engage a good lawyer. Most of the advocates in our society are perfectly fit into the adage "ALL FART NO SHIT". Most of them do not know the law. They will misguide you to drag your case so that they would devour your money for a long time. Don't get into this trap...! Time is precious..! Even if you have to shell out some extra money, please engage a good lawyer

2. Contest the case. Firstly, court will record her evidence. As usual, her side family members / close aides would have written the scriptt, screen play, direction....and your wife will act infront of the judge

3. The chances are that it will go on for years...if they choose to drag the case. This is where your lawyer plays a crucial role. He should ask for speedy trials

4. Be bold enough to speak to judge and ask for speedy trials considering the fact that your future is important

5. Gain enough proofs on her educational backgrounds, income, family's income /assets etc.

6. Next will be your evidence. Be precise and to the point during the evidence. In case if you are not thinking about the divorce..., make it a point that you're willing take her back. Rest is assured, once the wife steps into courts, she will never be interested to lead a life with you

7. Then it will be cross examination of both the parties. Her lawyer will cross examine you... and your lawyer has to cross examine her. The second one should precede the first one

8. Based on the mert, the judge will either grant the maintenance or dismiss the petition.

9. Collect enough proofs on maintenance judgements from the internet. If she has gone out of your house on her own, then prove this point. She will not be entitle for maintenance if she has deserted you wilfully

All the best.. Truth will finally win. Just be patient....
