Dear Experts,

If a wife continues her atrocities even after the husband has filed divorce case against her then in this context can the later instances of her cruelty be submitted /added in the written evidence stage during the proceedings.I am little confused and need your valuable comments on this. There is a Bombay High Court judgenent on this.

Thanks. The brief note is as below.

I filed divorce case against wife for physical and mental cruelty.I  the petition I cited several instances of her cruelty. She has continued to stay in my house and fighting the case. Even now she is continuing her cruelty on us. The case has reached evidence stage. What I wanted to know is that i have submtted our ( along with my witnesses)  Written Evedence wherein we detailed all instances of her cruelty  till NOW.  Is that fine?

Yes, the later instances of cruelty can also be added in the divorce petition.

Thanks but I am still confused. The divorce petition was filed long back. I have given all her latest instances of cruelty in my Evidence which was submitted only recently. I hope this is in order.
