hello everybody,

 

I need some case laws as so i dnt have to wait for a period of one year from marriage for filing divorce petetion......can i file it before one year from marriage...if so underwhat circumstances...

Divorce petition can be filed within the first year of marriage in cases of exceptional hardship to the petitioner or exceptional depravity on the part of the erring party/respondent. Exceptional Hardship means incomparable suffering, exceptional depravity on the other hand connotes torturesome conduct of an unprecedented level. If you can prima facie satisfy the court as to these requirements your divorce petition can be admitted within the first year.
