you have been given complete extract of the S/498a (which a paid lawyer will not give you) to understand that it is congnizable offence and once FIR is registered (even if false) no warrant is needed for arrest.

 

what else do you want in this FREE ADVISE.

 

BETTER PAY  AND ADVOCATE AND GET HIS SERVICES but beware even if you pay lawyer he will not allow you to be rude

Hi will not pay or not take free advise if lawyer is bad in english and not listening to problem

also my dilemma is there no warrant,I even gone to court for AB but they said without warrnt ab cant be given

Mr. Jadhav,  I have a very good opinion about you especially in the light of you narrating the bitter events that unfortunately took place in your life for which you had raised many questions to tackle the issues legally as well as effectively.  Well, what has gone wrong with you now that you are not able to understand the reply and instead are coming out with the same query again and again?  In my my last leg of reply, I will reproduce the contents for yur information:

"You can be confirmed of the FIR or arrest warrant only when you apply for AB, where, in their reply the police will confirm this and if there is no FIR pending against you, you may request the court to direct the police to not to arrest you in the case of a FIR being registered in the future on this issue."

By the above, I have very clearly stated that instead of begging the police to know about the present status of her complaint, you simply file an application for AB, if there is no FIR pending, the police will say so before the court, upon which you can request the court to pass an order directing the concerned Police to  'Not to Arrest" in the likely event of registering a FIR at the later stage based on the pending complaint before them. The court will certainly oblige and will pass orders accordingly, after which you can call on the police station for participating in the process of investigation by them without any fear of being taken into custody or remand.

Hi

pardon my comprehnsive ability

I had gone to court to file AB,a very senior and respectfull lawyer on level of exp like Mr Sudhir I met there,

he pointed his collegue to check any arrest warrnt in jcmc court but there was no warrant

 

he said without warrnt AB not possible,after 2 weeks again police had called me and same time had accident

 

he also advised not to directly ask police abt is there any fir etc because they may not take lightly ( maharashtra police is little bit rough)

 

also he well aware of fact wife left home 2 years ago he also seem to know 498a will not be valid

@ Kalaiselvan He is not a court before whom you should keep arguing for his benefit. He knows law better than you. He will not apply for AB till there is a warrant whereas arrest in case of 498a (false or true) doe snot require a warrant as you have eleborated.

two

 

who do experience for others to learn.
