Posession of property registration documents

Hi,

I have one query about Property Documents.

If someone else has posession of my property registration documents and because of some dispute with that person I cannot get my registration documents from him then is there any issue. Can i get duplicate Registration Documents from registrar. For example, I purchased a patch of land, registered it on my name with authority, executed all formalities and got my registration deed. I gave that registration deed to one of my friend to keep in safely with him but now due to some dispute with that friend, he is not giving me registration documents.

Please let me know what is the right options for me. Also tell me whether my friend can misuse those documents or cause any harm to me and my property as he has possession of those registration documents.

I will be highly thankful to all experts on the website to advise me on this.

1. FIRSTLY MAKE SURE THAT HAVE YOU COMPLETED THE PROCESS OF MUTATION WITH LAND RECORDS AFTER REGISTRATION? SOMETIMES, A GENERAL LAYMAN GET DOCUMENTS REGISTERED AND THINK THAT IT IS SUFFICIENT. BUT THE CHANGES IN THE LAND RECORD IS MUST. IF THE PROPERTY IS SITUATED WITH IN MUNICIPAL AREA, THEN THE NECESSARY CHANGES WILL BE DONE IN MUNICIPAL COMMITTEE/ CORPORATION, WHATEVER CASE IS APPLY AND IF THE PROPERTY SITUATED OUTSIDE THE MUNICIPAL LIMITS, THEN THE NECESSARY CHANGES WILL BE DONE IN PATWAR KHANNA BY PATWARI. THIS IS MUST FOR THE CHANGE OF OWNERSHIP, REGISTRY IS JUST A TRANSACTION AND NOT A CHANGE OF OWNERSHIP IN ITSELF. CHANGE OF OWNERSHIP IS DONE ON THE BEHALF OF REGISTRY.

 

2. YOU CAN FILE FIR AGAINST DOCUMENT HOLDER FOR THE SAME OR THE SAME IS LOST SOMEWHERE. HE (DOCUMENT HOLDER) CAN MAKE CONFLICT THAT YOU OWES MONEY FROM HIM AND GIVE HIM YOUR PROPERTY DOCUMENTS AS SECURITY. BECAUSE IT IS RARE THAT SOMEBODY GIVE OUR PROPERTY DOCUMENTS TO SOME OTHER PERSON WITH OUT REASON.

REGARDING OWNERSHIP, THERE IS NO THREAT TO YOU.

3. TAKING DUPLICATE OF THE REGISTERED DOCUMENTS IS NOT DIFFICULT. YOU CAN APPLY FOR THE SAME THROUGH AGENT (SERVICE PROVIDER). YOU CAN ALSO APPLY DIRECTLY, BUT YOU CAN GET INCONVIENENCE IN THIS REGARD. YOU WILL NEED SALE DEED  NO. AND DATE OF REGISTRATION FOR THIS PROCESS.

4. TRY TO RESOLVE THE MATTER IN THE CLOSED WALLS OF YOUR HOUSE MEANS AMICABLY, WHICH IS THE BEST OPTION. IF SOMEBODY CAN GUIDE HIM THAT RESTRAINING THE DOCUMENTS IS SPOILING HIS IMAGE AND RESULTS IN IMAGE LOSS TO HIM, THEN HE MAY PROBABLE RETURN THE DOCUMENTS TO YOU. BECAUSE THE DOCUMENTS ARE OF NO USE FOR HIM
