Presence needed

Hi

 Please tell me , whether my physical presence is needed for divorce cases. My wife filed divorce case and false allegation in divorce petition. I live in US. She is in India. 4 months after marriage she left India . After 10 months (dec 2011) she filed divorce petition on me. I have no issue granding her divorce. But allegations she mentioned in her petition were false. IS there a way to separate her allegations to separate case, so that i can divorce from her. I have enough eveidence to proof her false allegation.


Do i need to go India for hearing or i can give power of attorney to someone for my presence.

DEAR GOPI, your presence is once necessary during the time of evidences and you have to submit written statement on the behalf of allegations she filed on you,no need to file separate suit at this instant, firstly you have to defend this suit and after that you can file separate suit for divorce or we can also search some way out for this in this suit too.

i need some more details about this case

1 like where your marriage consumated

2. is she lived with you in us too

3.have you any child?

4.and about the authentification and relevancy of the evidences you have .

contact some good lawyer otherwise you can be forced to come india by the medium of presuuring us ambassy to deport you to india,do hurry before its too late.

beware...your absence will lead to exparte...

then cant defend even if she looted you...

or you cant claim much damages or assets in litigation...

moreover if she asks for moon can you willingly give?
