Guyz I have come across a case where a person had given and kept on giving representations of him being promoted to the Post Deputy director ( headquarter) from a law officer . At that point of time since 1987 there were no rules in this regard as to how a person can become a DDH but the offical practice was a person can do so if he is a Class 2 gazetted officer with minimum 10 yrs of experience . The applicant had so .. but as per the pay commssion 3rd of Punjab his pay was not the same of a Class 2 officer. he was selected aS LAW OFFICER FROM THE PUNJAB Pubic Service Commission in 1974 and was a class 2 public servant. The problem is we want to consider the case but I need some SC judgements to show that such a case can be considered now at this point of time and the affected party be given arrears . Can that be done ? please comment with relevant case law ASAP. Itz urgent.
