Property inheritance

I need some clarity on Property Inheritance Laws . If a father who owns the property has died without writing the will , and if he has 3 sons , who has by default right over the property .  How will it be partitioned . Similarly , if it is an ancestral property , who has the right over the property by default . 

And can one of the sons mortgage the property , if the other sons give a No Objection Certificate . ?

Similar query has been discussed in Experts section. It was suggested that :in yuor situation or any other situation the final call is to be taken by lender/bank and SBI has the resource and ability to ascertain such challenging assignments.

 

The share in ancestral/self acquired proerty is decided as per personal laws applicable to deceased owner.
