I
send legal notice to tenant who is not paying rent for 5 months .he refused the notice and telling he is ready to pay money to court he is very abusive and rude

he is not ready to vacate .if he pays rent to court will that not effect me

please suggest on this ?

If he is refusing to accept the notice then you don't worry, you can approach court with an eviction suit to evict him for default in rental payment. 

The court will consider the fact of default in rental payment as on the date of filing this eviction suit

The notice is presumed to be delivered u/s 27 of the General Clauses Act.

File a suit for eviction, recovery of arrears of rent and mense profits under the provisions of State Rent Control Act or Transfer of Property Act as applicable in your case through a local prudent lawyer.
