Property partition/settlement

  • We are 2 brothers - ME and BRO
  • BRO is married and lives in Jaipur
  • ME is married and lives in gurgaon with parents (at parental property, in name of mother)

We want to go for partition/settlement for parental property, as follows,

  • Property must remain in name of mother until death
  • ME will transfer to BRO, a sum equivalent to 1/3 of current property value, at which point BRO will surrender his prospective ownership on 1/3 portion
  • After mother, ME will possess 2/3 of property, while the remaining 1/3 will be partitioned equally between ME and BRO

What is procedure to undertake above along a legal and judicial path?

Settlement deed with life interest could be a possibilty.

Ask mother (owner) if she agrees to give 1/3rd ownership upon payment to you.
