Your query itself implies reply,  you want to construct tample illegally and unauthorisedly. 

Prima facie it is a time pass query.

You have not posted the material facts.

If proper permissions are obtained from Authorities after following lawful laid down the process for such conversion /usage for construction of such temple one can not treat it as illegal.   The society may decide, pass a resolution, get properly recommend, and get approvals and sanctions from Municipal authorities.

1. "Public Park" is classifed as a public "Recreational Ground (RG)" under the Regional Town Planning Act and the district's "Development Control Rules".

2. By virtue of the above, NO authority /court has jurisdiction to allow construction of a Temple or whatever in a area earmarked as "Public Park".  An existing Temple etc.... built on Public Park spaces has to be mandatorily demolished as per several HC /SC judgments.

3. Few extra-ordinarily  enterprising persons can build Temples in Public Park spaces, PROVIDED they are willing to undergo atleast three years of free Lodging & Boarding, in the State Prison.
