Can the quantum of maintenance be decided on the basis of physical abuse that the woman has suffered and not on the financial capabilities of the husband under Sec 125 CrPC, 1973? Please provide citations to prove that the maintenance can be awarded on the basis of physical abuse suffered and not only on the financial capabilities of the husband.

Mainteanance amount is granted due to the inabiliy of the wife to sustain her expenses and not for such acts of the husband.
She can seek remedy for that separately under different law
