Sir, I want to know, an executive came to Kolkata from Delhi and lodged in a hotel of room no 2 of new market area Kolkata, on 12.2.16 he was last seen in the hotel, thereafter his mobile went switched off. His father loaded a missing G. D in Newmarket P. S Kolkata and after a day lodged a complaint under IPC section 365/34 IPC. After 3/4 days on 18/2/16 Southport Police Station Kolkata recovered a fully decomposed body of a male which was identified by the deceased's father as his son. Now I would like to ask u sir whether a new murdercase will start at southport police station on the basis of the complaint of the deceased's father, or the complaint letter can be forwarded to Newmarket police station where already a case u/s 365/34 IPC is on progress. Can the letter of complaint be forwarded to Newmarket p. S or I have to record a case u/s 302 IPC and then only can send the case to Newmarket p. S. What are the provisions of law.
