Quotation of supreme court judgment

Dear Learned Members,

  In one of my cases, Ld Judge is refusing to accept citation of a Supreme Court judgment as he is saying that what I am quoting in my judgment is from the "head notes" section of the judgment and not the main body? Is this rejection valid?

Head notes is the editors version of the judgment. Hence headnotes are not binding as a precedent and cant be insisted for such purpose.

If you are willing to file citation then its batter to file citation example:

Heads notes……

Serial no. like 1,2,3           (2016) 4 SCC 1                    relevant Paragraph

 

When you file the citation along with the citation you have to give a judgement copy like (2016) 4 SCC 1

It is easy to get.
