Hello Learned Members,

 

Does ongoing RCR case protects husband (petitioner) from future DV cases ?  Your legal views would be really helpful.

both are indipendent cases so it will not help, but it is very useful for future case. your RCR and her DV dependupon the fact will decided.

Sir,

 

I agree to the point that cases will be decided on merit. Why i asked this question is that most of the relief sought by wife in DV are included in RCR. (i.e maintenance, right of residence etc etc).

U mean 2 say- wife filed RCR?

Even then, DV is separate identity. RCR means she wants 2 live wid u. Maint is sought U/S 24 in RCR. Clarify more, what is she asking in DV.

Thank you for replying to my post. I (husband) have filed RCR ..and wife has filed 498A. No FIR yet. However i see a chance that if i take back RCR they would very well file DV to get all reliefs mentioned in post above.

 

So , i am in confusion whether to continue with RCR or withdraw it ...
