Rectification Deed

I purchased a land in 1994 from the seller. He had acaquired the land from the society (alloted). The sale deed executed between the seller and myself has a reference to seller's  Khata. By mistake the Khata date has been entered wrongly in the sale deed. I have noticed it in 2010. I cannot trace the seller. what is the legal option I have to rectify this. thanks in advance for the reply

Khata  number is proper but the date is wrong. the Khata is referred  in the sale deed with a number and the date. (Khata ref abcd/93-94 dated dd/mm/yy) That date has been typed wrongly (specifically the mm is wrong. I read an article that says "one may file a suit before a court under Section 26 of the Specific Relief Act 1963". is that right? how des one do that? how much time does that take?. look forward to a legal solution

Hi,

In my sale deed, the property Khatha Number is mentioned incorrectly. instead of 496/461 it has been mentioned as 496/491.

All other particulars like site dimentions, bounded properties, site number etc are correct.

Is a rectification deed necessary?

Yes it is necessary.wihtout that you cannot enter ur name on ROR.

A property containing a vacant site and a Mangalore Tiled House was registered by "A" after executing Relinquishment Deed between two sisters "A" & "B".  But the Municipal Khatha Number of that property was wrong and else i.e. boundaries etc. was correct.  In the meanwhile "B" died and "A" sold the property to two persons.  What will be the consequence if some one objects to it.  Since in the Relinquishment Deed, the Khatha Number of the property was different (due to typhographical error) and it was registered with the incorrect number but the Khatha has been changed with the original number with the Municipality.  How can it be corrected?  Please anyone explain in detail procedure for correcting the same. Thanks in advance.
