Hello Experts,
I am an owner of a flat in a MHADA building in Mumbai. The buidling has a total of 60 tenants.
The concerned building is under redevelopment since 2010; where the builder has promised to provide alternate accommodation to all the tenants within the same premises. Additionally he is constructing one separate wing for the flats he can sell. The sale part is registered under RERA with completion date as April 2019.
Now I have below queries :
1) One of the members have complained to MHADA against the existing committee with regards to mismanagement of funds and non transparency. Based on his complaint MHADA has appointed a Registrar to check the society affairs and suspended the existing committee. My query is can one single member's complaint suspend the committee?
Also the complainant has a good rapport with the builder. Though the committee doesn't seem to be clean, but the intention of the complainant also look dubious.
2) Builder has stopped paying rent for around 8-10 months. When we ask builder for cheque he says check with Committee. When we ask Committee they say that they are no more in power.
Can you guide how should we approach for cheque?
3) The construction status of the building is -
out of the 12 floors , 11 floors are built and 1 is remaining. Builder says required approvals are pending from MHADA for the last slab. With no committee in power, can the registrar be approached for this matter as well as for rent?
4) Also how helpful to us is the RERA deadline of the sale part?
please guide and provide your valuable assistance.
UPDATE :
Currently some of the members have initiated a circular which says that we do not need registrar and we are happy with the existing committee. Also mentioning that the complainant is a nuisance creator and asked all the members to sign on it.
