Regarding appearing in person

Though lacking in formal legal education and regular practice in Courts, the Accused is somewhat

familiar with law and court procedures through self study. Accused is fully confident of winning the

case. Accused is having some financial trouble, and thus there is difficulty in engaging an Advocate.

In this situation, is there any problem in Accused arguing case IN PERSON ?

What are the specific advantages of engaging an Advocate ?

PLEASE NOTE IT IS NOT MANDATORY TO HIRE SERVICE OF AN ADVOCATE .THE PLANTIFF/DEFENDENT/ACCUSED CAN APPEAR IN PERSON AND FIGHT HIS/HER OWN CASE.You can have assitance of some knowledgeable friend  but he cant tender Vakalatnama in court and argue your case.

With all details/laws/cases available on internet now it is easy to find case laws and also various acts and prepare your points.

For serious cases one should not take chance as it is professionla job to handle court room proceeding and know strict steps to be followed during trial. But when you areon path of truth you really dont need much to assist you. 

You should read CrPC ,relevant clause sof IPC  , explanatory notes  to sections and Indian evidence Act regarding admissibility or various documents and oral evidences

Many people contesttheir own cases in person and have won.

 

While thereis huge risk for a common man to be on his own, thereare advnatages to stop and cut short gimmicks used by oppositelawyer. Courts too become more serious and foucced when a party is presenting case himself.
