Regarding full & final settlement

I worked with 1  automobile company for 4 and half year. i resigned and taken all the clearence from every department. i have letter from HR also. I have been following up for the full and final settlement since 1st april 2015 and have detailed mail communication with HR , many times they assured that it will be done in 10-15 days but it is still pending.

Pl suggest what to do now.?

While initiating such query, employee should post full information for better impression e.g;

 



What was your designation and nature of duties in offer/appointment letter/agreement and on record/ in practice? Did you have any power (not just recommendation) to sanction leave/increment/appoint/terminate? Can anyone cancel/amend/change/alter your recommendations?


Is any date of payment of wages mentioned in appointment letter?


How was salary paid; cash/cheque/in bank a/c?


You were in which state?


What is this establishment; Commercial/Industrial ?

 

What is its line of business (Noted;Automobile)?



Does it have Certified/Model standing orders and does it apply to your designation? (  If yes confirm it is (Model/certified). 


Are you a member of employees/trade unions?


What was your last drawn salary in Rupees?

You were under probation/confirmed? Is it mentioned in appointment letter that you are under probation period?

Has it been supplying salary slips ( at least a day before date of payment of wages)?


Did you get I.Card, Visiting card,salary slips of all months, acknowledgment of notice/final resignation and acceptance, correct FnF statement, PF a/c number and a/c slips, ESIC card,Form16, service certificate, relieving letter  {Noted; Yes (with good comments, confirm)}, NOC/NDC, handover of charge/assets etc?


How many persons were employed in it and what was max. no. at any time?

Has your FnF statement bee supplied by the company?

Designation - Assistant Manager ( M9 Grade ) & responsible for the sale of Spare Parts in assigned territory.

Had No power to sanction leave/increment/appoint/terminate.

No date mentioned in Appointment letter for the payment of wages.

Salary paid in Bank A/c only.

Company is Commercial Vehicle Manufactrur.

Last salary recieved for the month of Jan'15.

uploading salary slips on his site before the payment of wages.

ID Card - Yes but given back on last working day.

Visiting Card - yes

Salary Slips - Yes

Final Resignation Acceptance letter - Yes recieved

PF A/c No. - yes

Form 16 - Yes

NOCs from all departments - yes i have

FnF statement - Not recieved till date.

You have not replied to all points pointwise.

Had you replied, some inputs could have been passed on to you.

The company seems to have processes the salary, dues and that is why it has issued all salary slips and Form16 and has not released the dues and FnF statement.

You may check if salary slips and Form16 are correct.

You may approach a very able counsel specializing in Labor/service matters and under expert guidance of your counsel you may submit final representation to good offices of appointing authority, MD and narrate all representatiosn made so far (mention dates, names, brief minutes.....and promises made to supply the dues ) ................

 

Your counsel may opine, if covered, to approach;

Inspector appointed under Shops & Estbs Act

Payment of Wages Act

O/o Labor Commissioner

Civil Court

Lodge complaint u/s 406,420

File winding up petition
