Regarding stridhan in dv

Dear All,

498a,DV act applied over me...In 498a FIR IPC 406 not applied.In DV she demanded huge amount of Money,Stridhan.A false list of many gold and silver ornaments had been procuced by them.Can i have to give all the things demanded by them or court would ask them to prove that same had been given to her by her parents/relatives?What kind of proofs required?

This is normal in many cases filed under 498(a).

Judgments are not given on allegations. All the allegations are required to be proved beyond doubt.

You can disprove the allegations during the cross examinations.

Please understand that allegations cannopt be proved without sifficient evidences.

To prove the said allegations, they are required to prove the source of those articles, purchasing receipts such as invoices, proof to show that the said articles were given to you and the same are in your possession. They are also required to prove that you demanded the same.

Go and fight the case on its merit. The complainants in 498(a) becomes over confident without understanding that the false allegations raised by them really weakens their case.
