Rejoinder

Sir, My friend had purchased the land from the society before the acquisition of land by state govt. authority. Recently the authority dismanteled his home partially without giving him a resedential plot as per policy of acquisition.After that he filed a writ petition in Lucknow High court for stay. The opposite party submitted the counter and court said petitioner to file rejoinder.There was no date for filing the rejoinder in the order.The rejoinder was filed within six month from the date the counter was filed by opposite party. But now it is around seven months over the opposite party didn't filed the counter re-joinder.Is there any time limit within which the opposite party has to reply and what will be the consequences if the opposite party doesn't reply the rejoinder filed by petioner.My friend is affraid if the court dismisses the case.Please give the clear picture.

if the other side is not filingreply then tell your lawyer to ask the court for allowing to argue the matter and let the other party directly go for arguement instead of filing counter reply.
