well i m posting three queries here and both are interconnected.
1. Whether the strict provisions of CPC are applicable to the Rent Matters also, when the Rent matters are in fact dealt by a Tribunal and not by a civil court?
2. Whether Order 19 Rule 3 of CPC is neessary to be complied with in rent cases?
3. Whether the affidavits of the deponent, given in evidence,due to defective verification, can be rejected at the stage of arguments? at the time of tendering of affidavits and at the stage of cross examination there were no objections either from the court or from the opposite party. Moreover no question or suggestion was put to the deponent in this context.
pls try to find out few judgments as well on these aspects.
