Rental house rent increase issue

Dear Lawyers/Experters,

I'm Prakash from Bangalore and working in pvt IT company, Bangalore. I am currently stay in Rental house with my family since from Feb-14th-2011. 

As per the rental agreement currently i paid monthly rent Rs.8000/- rent plus Rs.100/- maintenance charges and after completion of 11month the price will be increase Rs.10% of rent

 But Dec 1st 2011 my house owner was said:

1.       From Jan 2012 onwards to increase rental Rs.12000/- and also u can shift any other house.

2.       The market price & demand increase so rent will increase.

 

When i occupied this house the owner was said:

1.       There are many tenant stay long back and no issue here.

2.       House Painting charges Rs.8000 for one month rent amount i paid.

Recently my house owner rented the second floor house for "Bachelor". They will pay more amounts. So he plan to increase rental and also inform vacate to the entire tenant.

Currently my daughter is doing nursery in near my home. So I can't shift right now and will extend to shifting April 2012(School end period).             I am ready to pay 10 to 20% but 50%  i can’t pay.

Please help and suggest to us.

Yes sir i have rental agreement from 5th-Feb-2011 to 11 month period.

The agreement is valid till Jan4th and he don't have any right to get you to vacate and if you revise @10% for the next year also he can't do any thing hence don't worry. Any issue approach court and pay the rent to the court and it will continue for next 5 to 10 years.

The agreement will be expired on 4th jan 2012. But he increase the "Jan" month rent  rs.12000/-.

Please confirm how can i approach court.

If i approach court first i will complaint police station or directly to approach court.

get a local advocate and file suit and pay rent in court.

I am also faced with a similar situation.

My lease is ending in the next few days. My current landlord proposed to increase the rent by 40% if I would like to continue further. The lease agreement said " at least 10% increase or mutually agreed". He is not listening and saying that the current market price is similar to this. However, the surrounding and facilities provided to us differs and the comparison is uncalled for. What should I do? I have a small family and not in a situation to relocate again.

Though I am ready to pay 10% increase as the lease agreement says so. Nothing beyond that.

Please help.

Please respond to my query above?

Can I stick with my decision to have 10% increase in the rent and oppose 40% hike as proposed by Landlord? Is there any law or act to support that?
