Rental property case - advice reqd

Hi everyone,

We have rented a property in T.nagar during 2004 for the rent of Rs.8,000/- with rental increase of 5% on completion of 2 years. After 2 years we didnt renew the rental agreement and the house owner is expired last year. At present we are paying the rent of Rs.14,000 p.m. His legal hier filed a case against us and they filed fair rent valuation given by licensed valuer as Rs.48,000/-. They have valued based on the recent tamilnadu guideline value. But the market rent near by is Rs.13,000 to Rs.16,000/-

As the case was in Small Cause court, i need the advice / clarification for the following queries.

1. Is the fair rent given by the licent valuer filed by house owner advocate is valid as it is very high compared to market rate

2. As the nearby tenants fear to give their rental agreement which will be a proof for showing market rent, how to submit the proof of market rent in court.

3. In the case house owner claimed hiked rent from the date of begining of the case. If the court has given judgement for hiked rent, whether we have to pay from begining 

4. Shall we go for appeal without paying the hiked rent from the begining period.

Pls give ur advice for the above.
