Respondent in the writ petition

Hi All,

Wife filed 498A case against the husband and in-laws at her place in Bombay saying that the alleged allegations and incidents all happened in chennai.

Bombay police investigated the matter and file charge sheet and all charge sheet allegations/incidents occured in Chennai.

Husband wants to file writ petition in Chennai High Court to get the case transfered to chennai. Who should be the respondent in this writ petition. Husband relies on the belwo citation:

IN THE HIGH COURT OF DELHI AT NEW DELHI

SUBJECT:  INDIAN PENAL CODE

WP(Crl.)No. 415/04

Reserved on: 22.10.2007

Date of Decision: 04.01.2008

You need to approach supreme court with transfer petition.

Normally, Husband or wife can put transfer petition to transfer the petition from the place where it is initiated to the place of convenience. If the source place and the destination place are in the same state then transfer petition has to be put in the high court of the same state. If the source place and the destination place are in the different state then transfer petition has to be put in the Supreme Court.
